General rental conditions for a Gite

​

TERMS AND CONDITIONS

Article 1
-This seasonal rental contract is reserved for the exclusive use of the rental of lodgings approved by the Gîtes de France de Haute-Savoie, on behalf of the National Federation of Gîtes de France. Under no circumstances can the National Federation of Gîtes de France and Gîtes de France de Haute-Savoie be held liable for any use of this contract by third parties or for purposes other than tourism.

Article 2
- Duration of stay: the customer, signatory of this contract concluded for a fixed period, may not under any circumstances invoke any right to remain in the premises at the end of the tourist stay.

Article 3
-Conclusion of the contract: the reservation becomes effective once the client has sent the owner a deposit of between 25% and 50% of the total rental amount and a copy of the contract signed before the date indicated on the front. A second copy is to be kept by the tenant.
The rental concluded between the parties to this deed may in no case benefit even partially to third parties, natural or legal persons, except with the written consent of the owner.
Any breach of this last paragraph would be liable to result in the immediate termination of the rental at the exclusive fault of the customer, the rental income remaining definitively acquired by the owner.

Article 4
- No withdrawal: for bookings made by mail, phone or internet, the customer does not benefit
the withdrawal period, in accordance with article L121-20-4 of the Consumer Code relating in particular to the provision of accommodation services provided on a date or at a determined periodicity.

Article 5
-Cancellation by the customer: any cancellation must be notified by registered letter to the owner.
a) Cancellation before arrival at the scene: the deposit remains with the owner. The latter may request the balance of the amount of the stay if the cancellation occurs

less than 30 days before the scheduled date of entry into the premises.
If the tenant does not appear within 24 hours of the arrival date indicated on the contract, this contract becomes void and the owner can dispose of his lodging. The deposit also remains with the owner who will request payment of the balance of the rental.
b) If the stay is shortened, the rental price remains fully acquired by the owner. No refund will be made.

Article 6
-Cancellation by the owner: the owner pays the customer all of the sums paid,

as well as compensation at least equal to that which the tenant would have borne

if the cancellation had been made by him on that date.

Article 7
- Arrival: the customer must present himself on the specified day and at the time mentioned on this contract. In case of late or delayed arrival, the customer must notify the owner.

Article 8
-Payment of the balance: the balance of the rental is paid upon entering the premises

Article 9
- Inventory: an inventory is drawn up jointly and signed by the client and the owner, or his representative, on arrival and departure from the gîte.

This inventory is the only reference in the event of a dispute concerning the inventory.
The state of cleanliness of the lodging on the arrival of the customer must be noted in the inventory. The cleaning of the premises is the responsibility of the customer during the rental period and before his departure. The amount of any cleaning costs is

established on the basis of calculation mentioned in the description sheet.

Article 10
- Security deposit: on arrival of the customer, a security deposit, the amount of which is indicated on the front of this contract, is requested by the owner. After the contradictory establishment of the exit inventory, this deposit is returned, after deduction of any cost of repairing the premises if damage is observed.
In the event of early departure (prior to the time mentioned on the contract) preventing the establishment of the inventory on the same day of the client's departure, the security deposit is returned by the owner within a period not exceeding one week.

Article 11
-Use of the premises: the client must ensure the peaceful nature of the rental and make use of it in accordance with the destination of the premises.

Article 12
- Reception capacity: this contract is established for a maximum capacity of people. If the number of customers exceeds the capacity, the owner can refuse the additional people.
Any modification or termination of the contract

on this point will be considered at the initiative of the customer.

Article 13
-Animals: this contract specifies whether the customer can stay in the company of a pet. In this case, the reception conditions will be mentioned on the description sheet. If animals are accepted, the description sheet specifies any price supplements to be expected

(price per animal, deposit supplement, cleaning fee supplement).
If the animals are not accepted and in the event of non-compliance with this clause by the customer, the owner may refuse them. This refusal can in no case be considered as a modification or a breach of the contract at the initiative of the owner, so that in the event

of early departure of the customer, no refund can be claimed.

Article 14
-Insurance: the customer is responsible for all damage caused by him. He is required to be insured by a resort-type insurance contract for these various risks.

Article 15
-Payment of charges: at the end of the stay, the customer must pay the owner

the charges not included in the price. Their amount is established

on the basis of calculation mentioned on this contract and in the description sheet.
Proof is provided by the owner.

Article 16
-Litigation: any complaint relating to the inventory of fixtures and to the description during a rental must be submitted to the departmental relay of Gîtes de France Haute-Savoie within 3 days of entering the premises. Any other complaint must be addressed to him as soon as possible, by letter.

-The cleaning of the premises is the responsibility of the customer
during the rental period

-Use of the premises: the client must ensure the peaceful nature of the rental and make use of it in accordance with the destination of the premises.

- Reception capacity: this contract is established for a maximum capacity of people. If the number of customers exceeds the capacity, the owner can refuse the additional people.
Any modification or termination of the contract on this point will be considered at the initiative of the customer.

-Animals: this contract specifies whether the customer can stay in the company of a pet. In this case the reception conditions will be mentioned on the descriptive sheet (clause by the client)

-In case of early departure of the customer, no refund can be claimed.

-Insurance: the customer is responsible for all damage caused by him. He is required to be insured by a liability insurance contract
